First: Trademark Verification Before Publication
Before publishing any listing, the platform performs an administrative verification of the trademark registration number and its validity through the Saudi Authority for Intellectual Property (SAIP) website. The advertiser is also required to provide an official trademark registration certificate.
This verification is limited to confirming the existence and validity of the trademark only. It does not constitute a legal review of the trademark's scope of protection, potential conflicts, or any existing or future disputes.
Second: Advertiser's Responsibility
The advertiser represents and warrants that they are the lawful owner of the trademark or have been officially authorized to act on behalf of the owner. The advertiser bears full responsibility for the accuracy of all submitted information and documents, as well as for any claims, disputes, or legal actions arising from the listing.
The advertiser further acknowledges full responsibility for any infringement of third-party rights and agrees to indemnify and hold the platform harmless from any damages, claims, liabilities, or costs resulting from inaccurate information or violations of applicable laws.
The advertiser grants the platform a non-exclusive, royalty-free, limited license to use the trademark name, logo, and related images solely for the purpose of displaying and promoting the listing on the platform and its affiliated marketing channels throughout the period the listing remains published or archived, including promotional materials created during the listing period.
The expiration of a listing or completion of a sale does not obligate the platform to remove previously published promotional materials unless required by applicable law.
Third: Scope of the Platform's Role
Trademarks are displayed on the platform solely for informational and promotional purposes as assets owned by their respective owners. Such display does not constitute commercial use of the trademark by the platform.
The platform does not guarantee that any trademark is free from objections, disputes, or future legal claims, nor does it guarantee the successful completion of a transfer or the generation of any financial return.
Fourth: User Precautions
Before completing any transaction, users should:
- Request the official trademark registration certificate.
- Verify the registration number through the SAIP website.
- Confirm that the advertiser's name matches the registered trademark owner.
- Document the agreement in writing with clear terms.
- Ensure there are no existing objections or disputes.
- Verify the identity of the other party.
Fifth: Payments
All payments are made directly between the parties.
The platform does not receive, hold, or participate in any financial transactions.
Users are strongly encouraged to use secure payment methods and document all financial agreements.
Sixth: Removal of Listings
If the platform receives credible evidence of a potential infringement or legal dispute, it reserves the right to suspend or permanently remove the listing without prior notice. Such action shall not be construed as an admission of liability or wrongdoing by any party.
Seventh: Limitation of Liability
By using this platform, you acknowledge that its role is limited to providing listing and marketplace services only, and that you assume full responsibility for any transactions you undertake.
Under no circumstances shall the platform be liable, directly or indirectly, for the content of listings or for any transactions conducted between users. If liability is established under applicable law, the platform's maximum liability shall not exceed the amount of fees actually paid to the platform.
